    GOSH !!! I just figured out I know this guy. I went to school with him (Kirby). He was a little older than me and he didnt go to Appalachia more than a year or so... but still its really sad... when some one dies.
    (I dont know details but I'm sure the family needs prayers)

    He will stand trial....The CWA is the county prosecutor, and he'll do just that, in a trial.

    What trial? He is guilty by association. Just depends on whether he was with the man the whole time, or an accessory to the fact.

    Some of you younger one's don't seem to get it. You don't have to be the person doing the crime to get the time.
    This man may of just been with the other one. But he is guilty as an associate.
    What part of that do you not understand. He may as well been the person firing the weapon. Or driving the vehicle, or talking to officers.
    Im not taking sides but had this been handled correctly i doubt any shot would of been fired or would there been anyone injured.
    Honestly sounds likes a huge over re-action by an untrained officer. Sorry but true. And had it went to a lot of shots fired. And civilians involved, well the county may be looking in a huge lawsuit.
    You want the truth well there it is. Justified shooting, i would say yes, necessary shooting, i would say no, not if officers had correctly handleded the situation.

    I know his family well. Kirby has been in and out of trouble quite a bit.
    LPDFTBL, he would be alive today if he had minded his own business. Not being harsh, but putting the blame where it lies. He created the situation, not the officers, who have a tough enough job as it is. They need our help, not our hindrance. Like you say, not taking sides....just being realistic.

    We usually agree on things Bro, but if I had been the offficer who fired the shots I would have done the same things. Sure, there were probably mistakes made early on in this. I don't understand how the man was able to get back into his vehicle and put the officers in this situation. That should not have happened. But If the shots were fired to protect an officer I would have to agree with that decision.

    The MOST dangerous thing that people in any society can do is to FAIL to question the actions of authorities or those employed to enforce the laws of that society.

    I wasn't there and believe me I know from first hand experience that things can be much different than they seem when later explained. But.......

    1. You never, ever reach into a vehicle that "might" pull away. You just don't do it. It's stupid.
    2. I question being in front of a vehicle that might pull away "officer had already rolled off hood".
    3. I question firing shots in that location. Chance of killing by-stander / customer is extremely high. Chance of hitting partner is high (happened).

    Now I'm not trying to blame the officers for this whole matter, however while working as a bouncer I've faced more dangerous situations than this sounded to be and I was never armed, perhaps if the officers hadn't been then nooone would be dead and noone seriously injured.

    Like LPDFTBL said, a little common sense goes a long way.

    you were a bouncer...so you are an expert in law enforcement...? i stand behind what the officers did and i feel for everyone involved.

    I never said it made me an expert in dealing with legal issues. My 28 years in various martial arts (Boxing-kickboxing-wrestling-CACC-Muay Thai-JKD-Karate-Grappling-Jit Jitsu-police tactics instructor-ect.) and my experience as bar security does give me an insight in violent acts and those who involve themselves in violent acts, especially while under the influence. My father having been a career police officer also gives me another angle.

    It's your right and even your duty to stand by your opinion, but it's also my right and duty. The fact that we don't argree has nothing to do with it.

    You shouldn't take being a bouncer lightly, Glory Days. Sure, at a place like the Fizz, you're not likely to see much violence...but now a place like Hog Wild where you can hang the term "redneck bar", it's a different story. I worked for 6 months in one of the worst redneck bars I've ever seen, a place called Roadies just outside of Cumberland, KY. You'd think being such a small place, there wouldn't be too many people, but on a Saturday night, there would be 500+ there regularly. That many people, you never know what could happen on any given night, and it usually did....from girl fights (seemed like every half hour), to a guy just right out in the open doing lines of coke on a table. Like Gotch said, bouncers may not be experts in law enforcements, but people that have done it have been around the criminal element and know what they're capable of.

    well im pretty sure these officers werent kickboxers or black belts...all they have is their instincts and they went with them...people are capable of a lot of things and i am not dissing bouncers but you don't have to go to an academy to become a bouncer
